Terms of Service

Welcome to Hi Video. These Terms of Service ("Terms") govern your access to and use of the Hi Video website, applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

To use certain features of the Service, you must create an account. When you create an account, you agree to:

• •Provide accurate, current, and complete information
• •Maintain and update your information to keep it accurate
• •Maintain the security of your account credentials
• •Accept responsibility for all activities that occur under your account
• •Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account and use the Service.

Hi Video operates on a credit-based system. Credits are used to generate AI-powered videos.

3.1 Credit Purchases

• •Credits are purchased through one-time payments (no subscriptions)
• •All prices are displayed in USD and include applicable taxes where required
• •Credits are non-transferable between accounts
• •Credits are valid for one (1) year from the date of purchase
• •Expired credits cannot be refunded or restored

3.2 Credit Usage

• •Each video generation (up to 10 seconds) costs 10 credits
• •Credits are deducted at the time of video generation request
• •If a video generation fails due to a system error, credits will be automatically refunded
• •Credits are not refunded for videos that complete successfully, regardless of output quality

4.1 Prorated Refunds for Unused Credits

You may request a refund for unused credits only. Refunds are calculated on a prorated basis:

Example: If you purchased 80 credits for $50 and used 30 credits to generate 3 videos, you may request a refund for the remaining 50 unused credits:

4.2 No Refunds for Used Credits

Credits that have been used to generate videos are non-refundable. This is because:

• •Video generation consumes significant GPU computational resources
• •These resources are billed to us regardless of whether you keep the video
• •The service has been rendered once a video is successfully generated

4.3 Refund Request Process

• •Refund requests must be submitted within 30 days of purchase
• •Contact us at support@hi.video with your account email and reason for refund
• •Refunds are processed within 5-10 business days
• •Refunds are issued to the original payment method
• •Processing fees may apply (typically 2.9% + $0.30 per Stripe's policy)

4.4 Exceptions

Full refunds (including for used credits) may be issued at our discretion in cases of:

• •Widespread service outages affecting your ability to use purchased credits
• •Billing errors or duplicate charges
• •Fraud or unauthorized purchases (subject to investigation)

You agree not to use the Service to:

• •Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• •Generate content that infringes on intellectual property rights of others
• •Generate deepfakes or misleading content intended to deceive others
• •Generate content depicting minors in any inappropriate context
• •Generate pornographic, sexually explicit, or adult content
• •Impersonate any person or entity without their consent
• •Attempt to circumvent any security measures or access restrictions
• •Use automated systems or bots to access the Service
• •Resell, redistribute, or sublicense access to the Service

Violation of this policy may result in immediate account termination without refund.

6.1 Your Content

You retain ownership of the images and videos you upload to the Service. By uploading content, you grant us a limited license to process and store your content solely for the purpose of providing the Service.

6.2 Generated Content

Subject to these Terms and applicable law, you own the videos generated through the Service using your credits. You may use generated content for personal and commercial purposes, provided such use complies with our Acceptable Use Policy and all applicable laws.

6.3 Our Intellectual Property

The Service, including its design, features, and underlying technology, is owned by Hi Video and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• •The Service will be uninterrupted, secure, or error-free
• •The results obtained from the Service will be accurate or reliable
• •The quality of generated videos will meet your expectations
• •Any errors in the Service will be corrected

To the maximum extent permitted by law, HI VIDEO shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• •Your use or inability to use the Service
• •Any unauthorized access to or use of our servers
• •Any interruption or cessation of transmission to or from the Service
• •Any bugs, viruses, or other harmful code transmitted through the Service

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Hi Video, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

• •Your right to use the Service will immediately cease
• •Unused credits may be forfeited (except where prohibited by law)
• •We may delete your account and associated data
• •Provisions that by their nature should survive termination will survive

You may terminate your account at any time by contacting us. Prorated refunds for unused credits are available as described in Section 4.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware.
